Most content on OMGBack.com originated from copies of old websites that are no longer active at their original URLs. Such content is usually obtained from the Wayback Machine at Archive.org using automated means. Usually this content was created by users of the original platforms or the platforms themselves. Whatever the case we are under no circumstances considered to be “information content providers” as defined by Section 230 of the Communications Decency Act because we are not “responsible, in whole or in part, for the creation or development of information provided through the Internet or any other interactive computer service” when the information in question was wholly created by users of other platforms or other platforms themselves. In such cases we are considered to be an “interactive computer service” which cannot be treated as the publisher or speaker of information created by another information content provider. The terms “interactive computer service” includes “any information service, system, or access software provider that provides or enables computer access by multiple users to a computer server, including specifically a service or system that provides access to the Internet and such systems operated or services offered by libraries or educational institutions.”
Some have alleged that because much our content is copied from elsewhere as opposed to manually being posted here directly by users that we no longer fit the definition of an interactive computer service and are instead information content providers. That simply is not true. If it were then our primary source of information (Archive.org) wouldn’t be protected by Section 230, but courts have repeatedly held that they are because even though the Internet Archive consists entirely of content copied from elsewhere it is still the speech of others and not the speech of the Internet Archive itself.
